Terms & Conditions:
Thank you for choosing Opal! ("us", "our", "we")
By using the Opal service or software applications, you are entering into a binding contract with our local company. Your agreement with us includes these Terms and Conditions of Use. If you don’t agree with these Terms, then please don’t use the service.
Occasionally we may, in our discretion, make changes to the Opal Terms and Conditions. When we make changes that we consider material, we are not obliged to notify or contact you. By simply continuing to use the service, even after those changes are made, you are expressing and acknowledging your acceptance of the changes.
Our aim is to make Opal an online destination you visit regularly. Please do not hesitate to share with us your concerns regarding our Terms and Conditions that you are about to read.
The Terms and Conditions below shall waive our responsibility of any financial commitment. 
We at Opal deploy all efforts to protect the confidentiality of both the vendor and buyer information, and we implore users to maintain the confidentiality of their own information.
The user of Opal alone (vendor/buyer) is held responsible for the accuracy of the provided information. Opal shall not be responsible for any incorrect information.
Displayed items are stored in Opal's fire and theft insured storage.
If the user engages in illegal practices, Opal has the full right to suspend or terminate the membership. Illegal practices are as follows:
    - Causing a network malfunction or obstructing the services of Opal.
    - Stealing or assuming someone else's identity.
    - Using Opal under someone else's username.
    - Using personal information for the purpose of harassment. 
    - Using Opal as a platform for competitive trading and commercial practices. 
    - Decoding or reverse-engineering the software of Opal.
    - Overriding restrictive procedures and domains designed to limit access to certain areas.
    - Harassing or threatening any of Opal’s staff and service providers.
    - Conducting commercial deals for personal benefit, such as displaying                 advertisements, blogs, and other commercial bulletins on Opal.
    - Deleting Opal's copyrights and intellectual property rights, or deleting any other             content or contribution on Opal.
    - Using Opal in ways that do not correspond with the regulations and Terms and            Conditions.
Registration:
By registering on Opal, you are agreeing to the terms and conditions.
Registering will enable you to use the different services of Opal. The information you provide must be accurate, correct, and complete.
Your username and password will be approved after you fill the customer information page. (Please refer to Opal's authority for further information).
Your password must be uniquely chosen in order to maintain safety. Any unauthorized login to your account must be reported to us immediately. 
Privacy policy:
Opal shall fully cooperate with legal departments and court rulings, if necessary, and disclose the identity and information of users who commit illegal action on Opal.
Completing your purchase:
In order to complete your purchasing transaction, the information below must be provided: 
    - Full name.
    - Phone number
    - E-Mail address.
Please make sure you enter correct payment information that confirms your identity.

Transaction approval:
Opal enables you to purchase one item at a time. When you add an item to your cart, it will be reserved for five minutes before another user gets the chance to claim it.
Once an item is chosen, an email will be sent to your mailbox with a detailed description of your order. Please note that we have the right to reject/decline your order. We shall waive all responsibilities if we eliminate any of the items displayed (whether for selling or inspection purposes) and we have the right to abstain from providing our services – or suspend an order –  to any user if we deem it necessary.
Payment method:
Opal only accepts K-Net, and payment is in Kuwaiti Dinar (KWD). Please note that an extra delivery charge of (--) will be added to the total amount.
Insurance and delay:
Your order will not be delivered to you without your civil ID and signature.
We guarantee that your order will be delivered to you within 24-48 hours, and we assure you that any delay would be caused by matters beyond our control. Therefore, we shall waive any responsibility concerning such a delay. You can, however, contact us and ask for cancellation and refund, provided that the request is made before the order arrives to your address for delivery.
We will make sure to contact you as soon as possible in the case of major delay to address any inconveniences it might cause, and we pledge that we will make our best efforts to alleviate this inconvenience. 
Vendor policies on Opal:
It is mandatory that all high-end accessories displayed for sale on Opal are original. The vendor must label the item by attaching a receipt/warranty/guarantee, which makes the item the responsibility of the vendor alone. Opal is solely responsible for showing the attached receipt/warranty/guarantee clearly and from all sides. In case of fraud, the vendor alone shall be held accountable. 
If the vendor breaches the above, Opal expressively waives its responsibility of the displayed content, as it is considered a clear breach of Kuwaiti Trade Law. 
Opal is designed for personal selling/buying use. It must not be used for purposes other than those stated and approved in this agreement. 
Pricing:                                                 - If the displayed item is priced in the range of KD 0 to KD 3,000, Opal shall take             8% of the purchase value.
    - If the displayed item is priced in the range of KD 3,001 to KD 6,000, Opal shall            take 6% of the purchase value.
    - If the displayed item is priced KD 6,000+ (and above), Opal shall take                   8% of the purchase value.
    - No items less than KD 20 are allowed.
Opal's authority:
Opal has the full right to suspend the system, whether temporarily or permanently. Opal shall waive any responsibility towards users in regards to such act. 
If deemed necessary, Opal has the full tight to reject a new password request.
Opal does not guarantee security or safety in its services, nor does it guarantee that the purchase/sale meets the user's expectations. Opal's is merely responsible for displaying and notifying the user of the order/sale transaction.
Opal has the full right to either support or delete some or all folders and messages provided by the users, whether temporarily or permanently when it deems it necessary. Opal shall waive any responsibility of the results of such a procedure. 
Opal fully owns the copyrights and intellectual property rights of its folders, software, designs, graphics, etc. whether bought or produced by Opal.
Opal has the right to publish any content displayed by its users (information, folders, software, designs, reports, messages, graphics, news). It is also likely that other users publish this content. In this case, Opal waives responsibility and any financial liability. 
Opal can and may change and/or add new regulations, terms and conditions, for technical and legal purposes in the future.
Opal has the full right to change certain services on its software.
Opal may undergo maintenance work. We shall notify you of any occurring update regarding either the suspension or termination of those services. Opal has the right to conduct repairs at any time when deemed necessary and needed. 
Opal's responsibility policy:
Under this agreement, Opal shall hereby provide its services as per stated above. We shall not guarantee, whether directly or indirectly stated, that the uploaded content on Opal is free of viruses or errors.
Under the conditions above, any Opal staff member, managers, owners, waive all responsibility for any loss or damage, whether direct or indirect (including business or profit losses and damage) and for any damages that could be induced from using those services. Nothing in these terms affects our liability for death or personal injury arising from our negligence.
Indemnity:
You hereby agree to indemnify, defend and hold (Opal staff/managers/owners -- whether the mother company or any of its subsidiaries) harmless from any and all liability, damage, loss, claim and expense (including reasonable legal fees) related to any breach by you of these Terms of Use. 
Intellectual property rights:
All the content in Opal App. (trademark, logos, graphics, scripts) are fully owned by Opal and has been licensed and secured by legal copyrights/intellectual property agreements -- both local and international, as well as by local and international commercial laws.
Without our prior written permission, you may not copy, modify, alter, reproduce, create derivative works from, publish, broadcast, distribute, sell, transfer or exploit any material on this website or the underlying software code whether in whole or in part. However, the contents of this website may be downloaded, printed or copied for your personal non-commercial use.
This content thus shall not be used in any manner that is likely to cause confusion among customers and users of Opal, or without a clear and prior approval from Opal.
